INTRODUCTORY PROVISIONS
- General terms and conditions apply to photography expeditions, photography workshops and photography courses organized by Marian Kuric – Marian Kuric, Banská ulica 35/28, 985 22 Cinobaňa, Slovak Republic, ID: 52914704 (Hereinafter referred to as “Organizer”)
- The organizer provides services (sells participation in photography workshops, photography expeditions and photography courses) based on an order on the website www.mariankuric.com.
- These General Terms and Conditions are part of the order for a photography workshop, photography expedition, or photography course concluded between the Organizer and the customer (the customer of the provided services).
Part I. – SUBJECT OF THE CONTRACT
The general terms and conditions establish the rights and obligations of the contractual parties (the Organizer and the customer) in the provision of the following services:
- photography workshops
- photographic expeditions
- photography courses
Part II. – CONTRACT PARTICIPANTS
The parties to the contract are:
a) Organizer – Marian Kuric – Marian Kuric, Banská ulica 35/28, 985 22 Cinobaňa, Slovak Republic, ID number: 52914704
b) customer – participant in a photography workshop, customer – participant in a photography expedition or customer – participant in a photography course (Hereinafter only “Customer”)
Part III. – ESTABLISHMENT OF THE CONTRACTUAL RELATIONSHIP AND SUBJECT OF THE CONTRACT
- Based on the order on the website www.mariankuric.com, a contractual relationship is created between the Organizer and the Customer
- The term of the photography workshop / photography expedition / photography course, and its length is clearly stated in the order of the photography workshop / photography expedition / photography course.
- Accommodation, meals and other services that may be mentioned in the order for a photography workshop / photography expedition / photography course organized by the Organizer are not part of the services provided by the Organizer
Part IV. – PAYMENT AND PRICE TERMS
- The customer is obliged to pay the entire price of the photography workshop / photography expedition / photography course
- The customer is obliged to pay the price of the photography workshop / photography expedition / photography course by the deadline specified in the workshop order by transfer to the Organizer’s bank account specified in the order.
- The amount of the price of the photography workshop / photography expedition / photography course, any advance payment for it and any discounts are specified in the order, unless the contracting parties agree otherwise based on written communication.
- The organizer (Marian Kuric – Marian Kuric, Banská ulica 35/28, 985 22 Cinobaňa, Slovak Republic, ID: 52914704) is not a VAT payer.
Part V. – RIGHTS AND OBLIGATIONS OF THE CUSTOMER
- Basic rights of the Customer:
a) the right to provide the agreed, ordered and paid service,
b) the right to protect personal data that is part of the order for a photography workshop / photography expedition / photography course
c) the right to information regarding the photography workshop / photography expedition / photography course and all services ordered and paid for, if this information is not published on the website www.mariankuric.com. The organizer usually provides this information to the Customer via e-mail or telephone communication
d) the right to timely notification of changes regarding ordered and paid for services via e-mail or telephone communication
e) the right to mediate participation in a photography workshop / photography expedition / photography course to a third person, if this third person meets the conditions for participation in a photography workshop / photography expedition / photography course. The customer is obliged to inform the Organizer about such mediation immediately and in writing via e-mail communication.
2. Basic obligations of the Customer:
a) provide the Organizer in the order for a photography workshop / photography expedition / photography course with true data that is necessary for the correct provision of the service ordered and paid for, including any changes to this data.
b) if the Customer is a person younger than 18 years and older than 15 years, submit the consent of the legal representatives to conclude a contract between the Customer and the Organizer.
c) arrive at the specified time at the venue of the photography workshop / photography expedition / photography course, which is specified in the order, if the venue is not specified otherwise through written (e-mail) communication,
d) follow the instructions of the organizer of the photography workshop / photography expedition / photography course, comply with the regulations of the country in which the photography workshop / photography expedition / photography course takes place, comply with the program of the photography workshop / photography expedition / photography course, comply with the rules of accommodation providers and carriers the customer uses the services (these services are not part of the services offered by the Organizer) and to comply with the customs regulations of the individual countries in which the photography workshop / photography expedition / photography course takes place. (Amount of transported commodities such as alcohol, etc.)
e) in the case of a photography workshop / photography expedition / photography course held abroad, to have with you all the necessary documents required for entry into the country where the photography workshop / photography expedition / photography course takes place, including transit countries,
f) fulfill vaccinations (or testing and other health obligations, including medical certificates) before traveling to the country in which the photography workshop / photography expedition / photography course takes place, if the country in question requires such obligations,
g) to avoid actions that would in any way violate the rights of other Customers, including actions that would endanger their health, life, or actions that could cause damage to other Customers’ property
Part VI. – OBLIGATIONS AND RIGHTS OF THE ORGANIZER
1. The Organizer’s obligations and rights are directly related to the Customer’s rights and obligations (Based on Part V).
2. The organizer is obliged to sufficiently and truthfully inform the Customer about all facts related to the contractual service, or about changes to these facts sufficiently in advance.
3. The organizer is not a travel agency or a travel agency because it does not provide services typical of a travel agency.
4. The services provided by the Organizer do not include accommodation, transport, insurance, food and other similar services typical of the services of travel agencies or travel agencies. At the same time, these services are not included in the price of the photography workshop / photography expedition / photography course.
5. Usporiadateľ poskytuje zákazníkovi iba službu v podobe vedenia fotografického workshopu / fotografickej expedície / fotografického kurzu.
Part VII. – CANCELLATION AND CHANGES IN ORDERED SERVICES
- Cancellation of the service by the Organizer:
The organizer has the right to cancel the photography workshop / photography expedition / photography course:
- If the minimum number of Customers is not reached. The minimum number of Customers is indicated on the information website www.mariankuric.com. The holding of the workshop is conditional upon reaching a predetermined minimum number of Customers.
- If an epidemiological or other extraordinary situation does not allow entry into the country where the photography workshop / photography expedition / photography course is to be held.
- In case of cancellation of a photography workshop / photography expedition / photography course by the Organizer, the Organizer is obliged to notify the Customer of this fact without delay through written communication (via e-mail) or telephone communication. In such a case, the organizer is obliged to inform the Customer of this fact no later than 24 hours before the start of the photography workshop / photography expedition / photography course
- In the event of cancellation of a photography workshop / photography expedition / photography course by the Organizer for the reasons mentioned in the previous points and in the event that the Customer has not in any way violated his obligations to which these General Terms and Conditions bind him, the Customer has the right to request participation in another similar photography workshop / photography expeditions / photography course in the event that such a photography workshop / photography expedition / photography course can be offered by the Organizer to the Customer. In this case, participation in the alternative date of the photography workshop / photography expedition / photography course will be confirmed by a new order from the Customer. If the amount of the replacement photography workshop / photography expedition / photography course is the same as in the case of the canceled service, any payment made by the Customer for this service will be transferred to the new order. If the amount of the replacement photography workshop / photography expedition / photography course is lower than in the case of the canceled service, the Organizer will immediately pay the difference in price to the Customer. If the amount of the replacement photography workshop / photography expedition / photography course is higher than in the case of the canceled service, the Customer shall immediately pay the difference in price to the Organizer. If the Customer does not place a new order, the Organizer is obliged to immediately (No later than 14 days) return to the customer the entire price for the service that the Customer has paid up to that time. In such a case, the customer is not obliged to pay for the cancellation of participation in the photography workshop / photography expedition / photography course. In such cases, the customer is also not entitled to any other compensation other than the amount he paid in advance for the service canceled by the Organizer.
2. Cancellation of the ordered service by the Customer:
The customer has the right to withdraw from participation in a photography workshop / photography expedition / photography course before it starts:
a) without giving a reason,
b) in the event that he does not conclude a new order on the basis of Part VII para. 1c) and 1d),
c) due to a breach of the Organizer’s obligations to which the order or these General Terms and Conditions oblige it
d) The Customer is obliged to immediately notify the Organizer of the cancellation of the ordered service in writing (e-mail) or by telephone.
Part VIII – CANCELLATION AND RELATED CHARGES
1. Cancellation fees in case of cancellation of the photography workshop / photography expedition / photography course by the Organizer:
- The Organizer will return to the Customer 100% of the funds that the Customer paid in advance to the Organizer’s account for the canceled photography workshop / photography expedition / photography course.
- b) In such a case, the Customer is not entitled to any other compensation from the Organizer except for the amount that the Customer paid in advance for the service canceled by the Organizer.
2. Cancellation fees in case of cancellation of participation in a photography workshop / photography expedition / photography course by the Customer:
- Cancellation of participation in a photography workshop / photography expedition / photography course 60 or more days before the start of the photography workshop / photography expedition / photography course, the Organizer will return to the Customer’s account the full amount (100%) of the funds paid by the Customer to the Organizer in the period before the cancellation of participation in photography workshop / photography expedition / photography course, unless otherwise specified in the order.
- Cancellation of participation in a photography workshop / photography expedition / photography course 21 to 59 days before the start of the photography workshop / photography expedition / photography course, the Organizer will return to the Customer’s account half (50%) of the funds paid by the Customer to the Organizer in the period before the cancellation of participation in the photography workshop / photography expedition / photography course, unless otherwise specified in the order.
- Cancellation of participation in a photography workshop / photography expedition / photography course 0 to 20 days before the start of the photography workshop / photography expedition / photography course or in the event that the Customer does not show up for the photography workshop / photography expedition / photography course without giving a reason, the Organizer will refund the account The Customer 0% of the funds paid by the Customer to the Organizer in the period before the cancellation of the participation in the photography workshop / photography expedition / photography course, unless otherwise specified in the order.
Part IX – COMPLAINTS
1. If the service provided by the Organizer is defective, the customer has the right to complain about this service.
2. The customer is obliged to notify the Organizer of the right to claim immediately after discovering a defect in the service provided orally or in writing, so that the correction can be made as soon as possible.
3. The organizer is obliged to issue a written confirmation of receipt of the complaint to the customer.
4. The customer is obliged to provide the Organizer with sufficient information and facts that led to the claim. At the same time, the Customer is obliged to cooperate sufficiently with the Organizer in the matter of complaints.
5. The right to claim does not apply to circumstances that do not directly depend on the activities or procedures of the Organizer (Adverse weather, other unexpected influences, force majeure)
6. In circumstances where the Customer does not fully or partially use the service provided by the Organizer, the Customer is not entitled to a refund of the amount paid as the price for the service. In such a case, the customer is also not entitled to a claim or a discount on the price of the service.
Part X – INSURANCE
1. Since the Organizer is not a travel agency or a travel agency, the services offered do not include insurance for trips abroad, insurance for mountain terrain, property insurance, accident insurance, liability insurance, etc.
2. The organizer is not responsible for any damage caused by the behavior of the customer, responsibility for possible injuries, death of the customer or actions that are not in accordance with the laws of the country in which the photography workshop / photography expedition / photography course takes place from start to finish photography workshop / photography expedition / photography course including travel to it.
3. In the case of events mentioned in part X par. 2 Neither the Customer nor anyone else is entitled to compensation, compensation or damages from the Organizer.
4. The customer is fully aware of the fact that, in the event of failure to take out the appropriate insurance at his own expense, he assumes full responsibility for the consequences of his actions and possible injuries during the photography workshop / photography expedition / photography course, including the trip there.
5. The customer is aware of the difficulty of the photography workshop / photography expedition / photography course through the information website www.mariankuric.com or through written (e-mail) communication with the Organizer.
6. The customer is fully responsible for his own safety during the entire duration of the workshop. The photography workshop / photography expedition / photography course can take place in difficult terrain in difficult weather conditions (strong wind, rain, snow, etc.). The Organizer is sufficiently informed of this fact in advance.
FINAL PROVISIONS
- By filling in the data in the order for a photography workshop / photography expedition / photography course, the Customer declares that he has familiarized himself with these General Terms and Conditions, that he has no objections to them, that he has fully understood them and will fully respect them.
- By filling in the data in the order of the photography workshop / photography expedition / photography course, the Customer declares that he did not conceal from the Organizer any health restrictions or problems known to the Customer that could jeopardize the course of the photography workshop / photography expedition / photography course. In such a case, it is necessary to discuss this fact with the Organizer.
- These General Terms and Conditions enter into force on 01. 04. 2022. These general terms and conditions govern the obligations incurred by the Organizer and the Customer arising from the date of their entry into force.
